Terms of Use & Service
These terms govern your use of ohadnissim.com (the "Site") and any mastering services provided by Ohad Nissim ("I", "me"). By using the Site or submitting a project, you agree to these terms.
1. The Site
The Site is provided for information and to let you contact me and submit projects for mastering. Content on the Site — including images, text, logos and the studio photography — belongs to me and may not be copied or reused without permission.
2. Submitting a project
- You confirm that you own, or have the necessary rights and permissions to, any audio you upload, and that mastering it will not infringe anyone else's rights.
- You must not submit material that is unlawful, or that you are not authorised to share.
- Submitting a project is a request for a quote; it does not create a binding contract until we both agree the scope, price and timeline.
3. Your audio and confidentiality
You keep all ownership of, and copyright in, your music. You grant me a limited licence to store and process your files only for the purpose of quoting and carrying out the mastering you request. I treat unreleased material as confidential and will not share or release it. Finished masters are delivered to you; I may reference completed, publicly released work in my credits and portfolio unless we agree otherwise in writing.
4. Fees and delivery
Prices, revisions and delivery timelines are agreed per project before work begins. Unless otherwise agreed, delivery of final files follows receipt of payment.
5. Revisions
Reasonable revisions to a master are included as agreed for each project. Additional changes beyond the agreed scope, or changes to the underlying mix, may be quoted separately.
6. Liability
I provide mastering services with professional care. To the fullest extent permitted by law, I am not liable for indirect or consequential losses, and my total liability for any project is limited to the fees paid for that project. Always keep your own backups of your original files — I am not responsible for loss of material you have not retained.
7. Third-party services
File uploads are handled by Samply and are subject to their terms. Your use of those features is also governed by the provider's own terms and privacy policy.
8. Governing law
These terms are governed by the laws of the Grand Duchy of Luxembourg, without regard to conflict-of-law rules. Nothing here removes any mandatory consumer rights you may have under the law of your country of residence.
